INTRODUCTION
These Terms of Use govern your purchases from, and your use of, the www.berbanto.com website and form a contract between you and Global Leather Export, a proprietorship firm owned by Mohammad Mahboob ur Rahman, having GSTIN 09CCRPR8604Q1ZE, with its registered office at 130, Chhabiley Purwa, Jajmau, Kanpur, Kanpur Nagar, Uttar Pradesh, 208010 (hereinafter “BERBANTO”). By making a purchase from, and using, this website you unconditionally agree to these Terms of Use and shall be bound by the same, along with other documents on the website which carry legal effect. Please ensure you have read and understood these Terms of Use when using our website.

BERBANTO is the licensed owner of the domain name https://www.berbanto.com/ and the content of this website – including but not limited to its design, layout, text, images, graphics, sound, video etc.

This Terms of Use document is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021.

For the purposes of this Terms of Use, “You” or “User” shall mean any natural or legal person who has agreed to become a buyer/potential buyer on the website by registering or transacting on the website. BERBANTO allows Users to browse the website and make purchases without registering. The terms “We”, “Us”, “Our” shall mean Global Leather Export (Berbanto).

This Terms of Use document is to be read in consonance with all other policies and documents published on this website.

ELIGIBILITY
Transactions on the website are available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons deemed incompetent to contract, including un-discharged insolvents, are not eligible to use the website. If you are under 18 years of age, you may use the website only with the supervision and consent of a parent or legal guardian. Transactions made by minors without supervision may be canceled by BERBANTO.

USER INFORMATION
(a) The User seeks to gain information about BERBANTO, its products, and related information.
(b) All personal information entered by the User on the website is done voluntarily.
(c) The User shall maintain confidentiality of login credentials and is solely responsible for activities under their account.
(d) BERBANTO reserves the right to suspend or terminate accounts if provided information is untrue, inaccurate, or incomplete.

COMMERCIALS
All prices on www.berbanto.com are inclusive of applicable GST and other indirect taxes. Tax rate changes after order placement may reflect in product prices without prior notice.

BERBANTO may offer discounts at its discretion for limited periods.

Payments may be made via credit/debit cards, UPI, net banking, wallets, or cash on delivery (COD). Payments are processed via Gokwik Solutions Private Limited with secure encryption, and banking transactions are managed by IndusInd Bank.

All transactions shall be in INR. Successful prepaid transactions will be confirmed via email/SMS.

COD availability is subject to serviceability of the shipping pin code and at BERBANTO’s discretion.

BERBANTO is not liable for failed transactions due to bank/UPI downtime.

Purchases above INR 2,00,000 require PAN card details to be submitted. Failure to do so may result in order cancellation.

CONFIRMATION
Upon receipt of your order, BERBANTO will send an electronic invoice as confirmation. This confirmation email also serves as proof of purchase.

DELIVERY
Orders are shipped only within India. Delivery to alternative addresses is at the User’s risk once confirmed by logistics providers.

The logistics partner will attempt delivery a maximum of three (3) times. Orders not delivered after three attempts may be canceled.

Multiple product orders may be shipped separately due to logistics or product availability.

Claims for missing items must be raised within 3 days of delivery.

Damaged/tampered packages should be refused at delivery and reported within 5 days.

RETURN AND CANCELLATION
For return and cancellation policies, please refer to the respective policy available on www.berbanto.com.

PROMO CODES
Promo codes must be applied during checkout. Codes cannot be applied post-purchase.

PROHIBITED ACTIONS
Users are prohibited from:

• Allowing unauthorized access to their account.
• Reselling or commercially exploiting products purchased.
• Violating Indian laws.
• Infringing BERBANTO’s intellectual property rights.
• Introducing harmful code, viruses, or malware into the system.

REPRESENTATIONS & WARRANTIES BY USER
The User represents and warrants that they are legally entitled to contract under the Indian Contract Act, 1872 and will comply with all applicable Indian laws including FEMA, Customs Act, IT Act, PMLA, FCRA, Income Tax Act, etc.

PERSONAL INFORMATION
BERBANTO treats all User data as confidential. For more details, refer to our Privacy Policy.

PRODUCT INFORMATION
BERBANTO reserves the right to adjust prices, change product details, or update product visuals without prior notice. Product images may vary slightly from delivered products due to color and screen differences.

COMPLAINTS TERMS

INDEMNITY
The User agrees to indemnify BERBANTO against any liabilities, losses, or damages resulting from misuse, misrepresentation, or violation of these Terms of Use.

LIMITATION OF LIABILITY
BERBANTO shall not be liable for indirect damages, delivery delays, downtime, data loss, or other economic harm.

FORCE MAJEURE
BERBANTO shall not be liable for failure to perform obligations due to events beyond its reasonable control including natural disasters, wars, regulatory changes, strikes, epidemics, or technology failures.

INTELLECTUAL PROPERTY RIGHTS
All trademarks, copyrights, and intellectual property on www.berbanto.com belong to BERBANTO. Unauthorized reproduction or use is strictly prohibited.

USER CONTENT
Any user-generated content on the website or social media tagged to BERBANTO remains the property of its creator. If you believe your rights are infringed, contact Customer Care.

RETENTION OF TITLE
Products remain property of BERBANTO until full payment and delivery are completed.

FRAUD
All attempts at fraud will be reported to authorities. BERBANTO reserves the right to cancel suspicious orders.

GOVERNING LAW & JURISDICTION
These Terms and Conditions shall be governed by and construed strictly in accordance with the laws of India. All disputes arising out of or in relation to these Terms shall be subject to the exclusive jurisdiction of the competent courts at Kanpur Nagar, Uttar Pradesh, India. Any arbitration or legal proceedings shall be conducted as per Indian legal standards and jurisdictional law.

TERMINATION
BERBANTO reserves the right to suspend or terminate accounts at its sole discretion without prior notice for violations of these Terms of Use.

COMMUNICATION
By using the website, Users consent to receive electronic communications from BERBANTO.

WAIVER
Failure to enforce any right or provision shall not constitute a waiver of such right or provision.

AMENDMENTS
BERBANTO may revise these Terms of Use periodically. Continued use of the website constitutes acceptance of the updated Terms.
